Terms and Conditions

Welcome to Webknown. By accessing our website or engaging our services, you agree to be bound by the following Terms and Conditions. Please read them carefully.

1. Definitions

"Agency," "We," "Us," or "Our" refers to Webknown (a Sole Proprietorship registered in India).

"Client," "You," or "Your" refers to the individual or business entity entering into a service agreement with Webknown.

"Project" refers to the scope of work agreed upon in the proposal/invoice (e.g., Web Development, App Development, Motion Graphics, etc.).

2. Payment Terms

To maintain workflow efficiency, our payment structure is strictly enforced:

  • Deposit: A non-refundable advance payment of 60% of the total project value is required to commence work. We will not begin any design or development until this deposit is received.
  • Final Payment: The remaining 40% is due upon project completion, prior to the final delivery of files, website migration to your live server, or app store submission.
  • Late Payments: Failure to clear dues within 7 days of the final invoice may result in a halt of services or the withholding of deliverables.

3. Refund & Cancellation Policy

  • Strict No-Refund Policy: Once the deposit is paid and the project has commenced (Kick-off), we do not offer monetary refunds under any circumstances.
  • Modifications: If you are dissatisfied with the initial direction, we are committed to modifying the project within the agreed scope to meet your satisfaction.
  • Cancellation: If you choose to cancel the project midway, the initial 60% deposit will be forfeited to cover the time and resources already utilized.

4. Revisions & Approval

We strive for perfection but require clear boundaries to ensure timely delivery:

  • Revision Limit: We provide up to 4 rounds of revisions for free during the design/development phase.
  • Excess Revisions: Any revisions beyond the included 4 rounds will be charged separately at our standard hourly rate.
  • Final Approval: Once you provide written or verbal approval on a final draft/milestone, the project is considered "Closed." Any changes requested after final approval will be treated as a new scope of work and charged accordingly.

5. Intellectual Property (IP) & Source Files

  • Ownership Transfer: Intellectual Property rights for the final output are transferred to the Client only after full payment (100%) has been received. Until then, all code and designs remain the property of Webknown.
  • Portfolio Rights: You grant Webknown the right to showcase your project (logos, website screenshots, app interfaces, videos) in our portfolio, social media, and marketing materials to demonstrate our capabilities.
  • Source Files (Motion Graphics & Graphic Design):
    • For Motion Graphics and Graphic Design projects, we deliver the Final Output Only (e.g., .MP4, .MOV, .PNG, .JPG, .PDF).
    • We do not provide editable source files (e.g., After Effects project files, Photoshop .PSD, Illustrator .AI) unless specifically agreed upon in the initial quote with a "Source File Buyout Fee."

6. Digital Marketing & SEO Disclaimer

  • No Guarantees: While we use industry-best practices, Webknown does not guarantee specific results (e.g., "#1 Ranking on Google," "Specific ROI," or "Viral Growth"). Search engine algorithms and social media policies are third-party systems outside our control.
  • Commitment: We guarantee to execute the agreed-upon strategy to the best of our ability to improve your current metrics.

7. Client Responsibilities

  • Content Delivery: You agree to provide all necessary text, images, and credentials required for the project in a timely manner.
  • Delays: If the project is stalled for more than 30 days due to a lack of response or content from your side, Webknown reserves the right to put the project on hold or mark it as complete. Reactivating a dormant project may incur a re-engagement fee.

8. Limitation of Liability

Webknown shall not be liable for any indirect, special, or consequential damages, including but not limited to loss of data, loss of profits, or business interruption arising out of the use of our services or deliverables.

9. Governing Law & Jurisdiction

These Terms and Conditions are governed by the laws of India. Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the courts in Jharkhand, India.
